Why, are you planning to steal his game out from under him? If Caizer wants to sue for damages or something, he should register officially for copyright (if he hasn't already). However, from the moment you create something . Since he also lists it on his Patreon page and it's been publicly there for a long time now, it could be pretty easy to claim his own copyright, depending on in what court the case might land.

Since I'm not he, I can't say what he may or may not have done. But I think your attitude is disgusting. Assuming what you suggest were true, you imply that if someone can't afford to sue over their creative work somehow that justifies stealing it from them. If nothing else, I find that morally reprehensible. There's a huge difference between downloading someone's creation without permission to play it and trying to take their creation from them entirely and claim it as your own.
Registration is required to seek statutory damages. Caizer doesn't want anything to do with this game lol. Why would he seek damages? First he'd have to prove someone is using his "game" to make money he would have otherwise made. An idea can't be copyrighted so he'd have to make the case for the use of his unique assets if he even has any.

And the amount of money "made" would have to be large enough to make it worthwhile for attornies to be actionable anyway.

Also Caizer effectively abandoned his copyright anyway. See.

Not sure why you'd cite as support for your point a case where "Under the totality of the circumstances, the court rejects [the] waiver and abandonment defenses, and finds that the use of the screen scenes . . . did infringe upon movant's copyrighted creations". In that first case you linked the court found against claim of free use of the material, not for it. Also, the phrase you're supposedly quoting here isn't even found in the case ruling; just searching that document for any of the following single words from your quote here shows no results: performs, overt, intention. The word intent does show some hits, but none of them match your quote.

On the matter of waiving rights, Caizer has said specifically he plans to get back to this game after he hits a certain financial goal. He might never hit that goal, but I don't call that copyright waiver or willful abandonment. However, the burden has becoming increasingly heavier on plaintiffs in cases, whereas defendants aren't nearly as restrictive. So actually winning a court case on the matter is much more difficult, it's true.

In any case, it doesn't matter. I've already said my piece. You can obviously try to do what you want and see what happens. It's very possible there would be no consequence at all.

One thing that you need to be careful about on this defense is that the developer still has it up as one of their works on their active patreon page. Just because3 they have said they are putting on the back burner for now, does not always constitute abandonment.

Man, just found this game. Are there no plans at all to continue? This was great!
No, but the dev does have another game, Happy Summer, in which you can simulate a life with more tedium and monotony than even the most mundane parts of your real life, with interesting lewd scenes happening magnitudes less frequently than if you exclusively sat alone in your living room watching science documentaries by day and simply allowed your normal REM sleep to function as intended, without actually trying to trigger sexy time dreams while you sleep.

You can also support the dev on Patreon, which you might like, because, as a patron, you will gain access to dev's exclusive Discord channel, where if you so much as ask the most innocuous question about this game, you will be insta-banned for life.

Because the dev loves his patrons.
