The thing is companys in jav industry CAN circumvented the law (the one that make cospuri, spermmania, legsjapan,... which I guess is achieved by creating an oversea branch).
Perhaps I could have been less harsh but it's a valid complain.
Just as you said, you COULD circumvent that law, but is it financially viable?
First of all, you should have to create a overseas branch, what would not be cheap. Secondly - You must produce two versions. A lot of that "mosaic" is actually not hiding some drawing, but is just that - Mosaic. In short, a lot of extra work has to be done, just for that western version.
All that stuff above won't be cheap (at least if you want to uphold quality). Do not forget VN's are not massively sold outside of Japan. At best it is a marginal market, and the profits are razor thin. What brings it back to the original question - Is it financially viable?
That answer is probably a "yes, but". Maybe the make some meager profit if the sales are really, really good. Anything less, and they loose money on it. Most publishers/developers won't take that kind of high risk, and can you really blame them?

Actually yes, I'm not so fragile that I'd lose my shit over coming across something unexpected in one scene, and I'd gladly trade that for tags being useful for finding what various games are really about.
A more complex tag system would be nice - e.g. like AniDB, where each tag has a weight of up to 3 stars, noting how prevalent the tag's content is in the series.
Honestly we just need better policing of the current one.
I've said this before and I'll say it again. For a tag system on any kind of content to make sense the content being tagged must only have a tag if that tag describes a significant or important part of the content in question.
For example you wouldn't tag every movie ever that has even a single sex scene as porn. It's just misleading. And yet that's exactly how tags are applied here.
No you're not... and the weird thing is my Defender didn't detect it the first time I scanned this game a few days ago.
Sadly, that is the risk people will have to take in order to pirate games.

The purpose of tags is to provide a complete overview of what the game contains so people can blacklist or target search, your 'making sense' version would be inconsistent and arbitrary. Who decides if it's significant or important?
Thing is, the way it is right now you might as well blacklist everything because ever game has every tag under the sun. Why else do you think that every time a game is posted the first thing that happens is a million questions about how much of a tag is actually in it?
Ultimately though I think you have an overinflated idea of what I mean when I say significant. Basically, it boils down to this. Is the tag something that the game actually contains in any meaningful way, or is it just a throwaway scene somewhere in the middle.
For example, Friday the 13th is not a porn series just because it has some teenagers that are about to get fucking when Jason shows up to spoil their fun with a machete. And conversely a game with a single footjob is not femdom, a game with a single kiss is not romance and a game that contains a poster of a slasher movie on the wall in one scene is not graphic violence.
And you are not doing anyone a favor by making them blacklist them all because the tags told them that this is what they were. All you are doing is making the tags meaningless.
At this point I think you'll realize that I am not exactly setting a hugely high bar to clear. Nor am I unaware of the fact that some tags (hint: NTR) are more sensitive than others. But all I am advocating for is a tiny bit of common sense. Just enough to make a tag actually mean something.
