Doubts before publishing a game

Hi all,

I've been working on a game and I'll publish it as soon as I finish adding some more events and configuring some things.

But I'm a bit worried about the legality issue if I share it through Patreon, it's a HTML game with images and videos with copyrighted content and explicit content and it's forbidden but I've seen that many who have made a game of this type do it without problem, I've been researching in the forum but I still have many doubts and I would like to read your recommendations. I would appreciate it.

I like to develop it and more if I can share it with you without having legal problems or any other problem that makes me stop the development. I read you.

There are ~100 games on f95 with real porn updated in the last month alone. Most of them, if not all, have an active patreon.

All it takes is one person to report you to Patreon for their team to consider reviewing your content. From there, you could expect your page frozen while they investigate. They may give you the option to remove the content and offer content without IP issues and other issues (since you say "forbidden" content). They may just skip that and terminate your page and ban you from being one of their creators in the future, as well.

Then again, you could skate by for years without incident.... only for then to have a disgruntled fan report you.

Or you may be scot free for the entire life of your account.

Perhaps you should consider alternatives, if you are concerned.

No one here is an attorney... except those that are. And those that are will not give you any legal advice without you being a client.

People who knowingly take content from creators without intending ever to compensate those creators really aren't the best people to get legal/contract recommendations from.

If you use it very sparingly you'll fare a better chance of not getting booted. If your opening scene is Brazzers 2.0 that's going to reflect badly on them by their overlords (credit card companies) and they will boot you.

Some of the biggest real porn devs have been faced with shutdown and resorted to deleting all of the media content from their games ("fan made" media packs then pop up here to replace it). I know one dev who uses real porn who recently said that getting shut down by Patreon is a constant source of worry and stress for him because he relies on the income.

So think hard before you decide to make your game this way!

So think hard before you decide to make your game this way!
I wouldn't mind sharing my content for free and only through this forum but on the other hand I would also like to open a platform where I can earn some income through it as that would allow me to be able to spend more time developing the game and people who possibly like the game can express support through donations.

I have been looking at some other alternatives to Patreon that I may not have any future problems with but so far I don't know of any. Anyway any recommendation that someone wants to give me and doesn't want to put it here publicly, I would be happy to accept it through a private message.

Finally the only thing that has occurred to me is to open the Patreon without publishing absolutely nothing about the game. Just share the progress or some informative messages about it without mentioning it directly, I don't know if this way Patreon has no right to ban me because I haven't shared anything about the game or any direct content.

they always have a right to ban you, even if they explicitly told you that your content is fine with them. if you look at the TOS of ANY social platform there's ALWAYS a bit that says they reserve the right to unilaterally terminate your account any time they wish with for any reason they like. which also means they don't even need to obey their own rules.

Patron has every right to ban a person if they do not follow their rules.

that's an unhelpful and pointless answer. instead you could have been helpful and told him what I and others have told you, that it's about what you fund through patreon, not only about what you link from patreon.

Endark, patreon don't allow you to fund anything through patreon that is breaking their rules. if you don't link to the game from patreon, it reduces the risk of someone reporting the content from seeing it on patreon, but someone playing the game could still report your game to patreon for breaking their rules and patreon will then see you funding your game through patreon.

Also, the median adult game developer on Patreon only brings in $106 USD per month after two years on the platform. That's another thing to consider - is the risk of being banned from ever using Patreon as a creator in the long-term worth a couple of dollars per month in the short-term?

My question is how certain games manage to avoid bans. It's quite easy to get reported, either because someone is unhappy about taking too long to update the game, out of envy or any other personal reason or just for no reason at all.

Yes, that's what I thought. I'll publish it and share it with you. If you enjoy my game and story, I'll explore potential avenues for its further development and future support.

However, I don't believe I can publish it in its entirety, as my style involves a sandbox approach, continuously introducing more content as I progress. Currently, my plan is to further develop this game (which will take some time if I choose to continue), so creating another game that aligns with the Patreon TOS/Community Guidelines is not in my current plans.

Actually many people do it, so if it were totally forbidden they wouldn't do it (or they don't mind taking the risk or they have some way to avoid it).


The future is uncertain, some end up developing in the long run and I'm referring to those that use content of the same type as what I'm using. I mention it again an HTML game with copyrighted content, just plain, real porn content.

I know what you are trying to do and yeah there is always the risk of a report and for most people it is just blind luck Plus I don't think there is a massive audience for real porn games and not to mention alot of people don't bother with Html games in the first place like 70 percent of Html games I have seen follow a same Ui pattern which is not engaging at all Unless you write some Good Text For it you should try making something in Renpy or like Rpgm and make that real porn based you can also create ai art that isn't bad too
