It's basically creating a difference between how much of the assets actually get used when creating new work.
If you have a game like a VN, even if it's animated then they don't count towards the "3d game" rule. Once you create a render then everything in that render becomes "new work" and you own the copyright to it, providing there wasn't some weird licence from some other site.

A good rule of thumb is if you think you're putting in enough of the assets into the game to be able to extract it and use it in gmod then you're moving into "3d game" licencing territory.

Caveat: This is just my interpretation of the rule.
